they aren’t ‘defending’ mifepristone–they want the case dismissed, as in no ruling.
they’re looking at a probable ruling against the current magat agenda and they don’t want that on the books so that the brain worm can just ctrl-z and undo its approvals.

Methinks this is just “this case won’t result in as harsh an adjudication as we’d like” so…
Kill off this suit and pave the way for a different suit with the likelihood of an even much worse adjudication result.

These guys are in charge of FDA now. They can just start introducing Rx restrictions on the drug through the administrative process. They don’t need to rely on an obsolete statute and one wildcat judge in Amarillo.
